Terms of Service

These Terms of Service ("Terms") govern your use of the Noctuary platform operated by Noctuary ("we", "us", "our"). By accessing or using Noctuary, you agree to these Terms.
1. The service
Noctuary provides an AI-powered incident context platform that processes OpenTelemetry log streams, extracts structured signals, and generates incident hypotheses to assist engineering teams during incident response.
2. Account registration
You must provide accurate information when creating an account. You are responsible for maintaining the security of your API keys and credentials. Notify us immediately at [email protected] if you suspect unauthorised access to your account.
3. Acceptable use
You may use Noctuary for legitimate incident management and observability purposes. You may not:
- Use the service to process data you are not authorised to access
- Attempt to circumvent authentication or access other tenants' data
- Send excessive API requests that degrade service quality for other users
- Reverse engineer or attempt to extract proprietary algorithms
4. Your data
You retain ownership of all data you send to Noctuary. You grant us a limited licence to process that data solely to provide the service. We do not use your data to train models or share it with third parties outside of what is described in our Privacy Policy.
5. Service availability
We aim for high availability but do not guarantee uninterrupted service. Noctuary is a complement to your existing observability stack — it should not be your sole means of incident detection. We will use commercially reasonable efforts to provide advance notice of planned maintenance.
6. Pricing and payment
The free trial period is 30 days. After the trial, continued use requires a paid subscription at the rate applicable to your plan. All fees are non-refundable except where required by law.
7. Limitation of liability
Noctuary is a diagnostic aid. Engineers remain responsible for all decisions made during incident response. We are not liable for incidents, outages, or losses arising from the use or inability to use the service, or from reliance on any hypothesis or recommendation generated by the platform.
To the maximum extent permitted by law, our total liability for any claim shall not exceed the fees you paid to us in the three months preceding the claim.
8. Termination
Either party may terminate at any time. Upon termination, your API keys are revoked and your data is deleted within 30 days, unless you request immediate deletion.
9. Changes to these terms
We may update these Terms. We will notify you of material changes by email or by posting a notice in the dashboard. Continued use after the effective date constitutes acceptance.
10. Governing law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
